Terms & Conditions – Ouma Bets Gebak

Welcome to Ouma Bets Gebak.

These Terms & Conditions govern the use of our website, the placing of orders, the purchase of products, collections, deliveries and any interaction with Ouma Bets Gebak.

By accessing our website, placing an order, purchasing any product, collecting an order, accepting delivery of an order, or communicating with Ouma Bets Gebak, you agree to be bound by these Terms & Conditions, together with our Shipping Policy, Refund Policy and Privacy Policy.

If you do not agree with these Terms & Conditions, please do not use our website or place an order.

  1. About Ouma Bets Gebak

Ouma Bets Gebak is a bakery business operating in South Africa.

We prepare freshly baked goods which may be collected from our premises or delivered through third-party courier services.

By placing an order, you confirm that you are at least 18 years of age or that you have permission from a parent or legal guardian.

All prices are displayed in South African Rand (ZAR). VAT is included in the product price where applicable.

  1. Orders and Acceptance

Once an order is placed, it is considered final.

An order confirmation email confirms that we have received your order. It does not guarantee product availability, courier performance, delivery timelines or acceptance of the order in every circumstance.

Ouma Bets Gebak reserves the right, at its sole discretion, to:

• Accept or decline any order
• Cancel any order
• Refund any order
• Limit quantities ordered
• Refuse future orders
• Block or restrict customers from ordering
• Refuse service where reasonably necessary

This may apply in circumstances including, but not limited to:

• Stock limitations
• Operational capacity
• Suspected fraud
• Payment concerns
• Incorrect pricing or website errors
• Abuse of discounts or promotions
• Abusive, threatening or inappropriate conduct
• Breach of these Terms & Conditions
• Suspected unauthorised resale or redistribution
• Suspected misuse of the Ouma Bets Gebak name, brand or reputation
• Any activity that may harm Ouma Bets Gebak, its staff, operations, customers, products, brand, reputation or customer experience
• Any unforeseen circumstances outside of our reasonable control

Ouma Bets Gebak may cancel and refund an order before fulfilment if we believe the order should not proceed. Acceptance of payment does not remove our right to cancel, refund, decline or refuse fulfilment where necessary.

  1. Product Availability

All products are subject to availability.

Because our products are freshly prepared, availability may be affected by stock, ingredients, production capacity, equipment failure, supplier issues, staff availability, load shedding, operational disruptions or other circumstances outside of our control.

If a product becomes unavailable after an order has been placed, Ouma Bets Gebak may, at its discretion:

• Offer a suitable replacement
• Contact the customer to make alternative arrangements
• Cancel the unavailable item
• Cancel and refund the order

  1. Product Descriptions and Images

We make every reasonable effort to ensure that product descriptions, flavours, images and information on our website are accurate.

However, product images are for illustrative purposes only.

Because our products are handmade, slight variations may occur in:

• Size
• Shape
• Colour
• Decoration
• Filling appearance
• Packaging
• Final visual presentation

These variations do not automatically qualify as defects.

Customers are responsible for reading product descriptions, flavour information, shelf-life details, storage instructions and policies before placing an order.

  1. Wholesale, Resale and Unauthorised Commercial Use

Ouma Bets Gebak does not offer wholesale, reseller, distributor or stockist arrangements unless a separate written agreement has been signed by an authorised representative of Ouma Bets Gebak.

Placing an order with Ouma Bets Gebak does not give any customer, person, shop, café, market, online store, reseller, third-party business or organisation permission to resell, redistribute, repackage, relabel, advertise, display, promote or commercially exploit Ouma Bets Gebak products.

By placing an order, the customer agrees that:

• Products are sold for personal consumption, gifting or approved private use only
• No order may be placed for unauthorised resale or redistribution
• No customer may resell Ouma Bets Gebak products through a shop, café, restaurant, market, event, online store, website, social media page, delivery platform, third-party business or any other commercial channel without prior written approval
• No customer may represent themselves as an authorised reseller, stockist, distributor, supplier, agent, partner or representative of Ouma Bets Gebak
• No customer may use the Ouma Bets Gebak name, logo, trading style, product names, product descriptions, photographs, videos, packaging, social media content, branding or any similar identifying material for resale, promotion, advertising or commercial purposes without prior written permission
• No customer may advertise, display, promote or sell any product in a way that may create the impression that the product, business, outlet or person is approved by, supplied by, connected to, endorsed by or affiliated with Ouma Bets Gebak
• No customer may repackage, relabel, alter, remove labels from or present Ouma Bets Gebak products as their own products
• No customer may combine Ouma Bets Gebak products with another business offering in a way that suggests an official collaboration, partnership or approval without written permission
• No customer may use Ouma Bets Gebak products as part of a paid commercial promotion, giveaway, hamper, resale bundle, catering package or business offering without written approval

For the avoidance of doubt:

• Bulk orders do not create wholesale rights
• Repeat orders do not create reseller rights
• Discounted orders do not create resale rights
• Successful payment does not create resale rights
• Fulfilment of a previous order does not create future permission to resell
• Informal discussions do not create permission to resell
• Silence, delay or failure by Ouma Bets Gebak to act immediately does not mean permission has been granted
• Permission must be in writing and must come from an authorised representative of Ouma Bets Gebak

Ouma Bets Gebak reserves the right to decline, cancel, refund, limit or refuse any order where we reasonably suspect that the order is intended for unauthorised resale, redistribution, commercial use, repackaging, relabelling, brand misuse, passing off, misleading advertising or any conduct that may harm our brand, reputation or customer experience.

If unauthorised resale, redistribution, misleading representation, brand misuse or passing off is suspected or identified, Ouma Bets Gebak may require the person or business involved to immediately:

• Remove all Ouma Bets Gebak products from sale
• Remove all references to Ouma Bets Gebak from social media, websites, advertisements, shelves, menus, signage and marketing material
• Stop using the Ouma Bets Gebak name, branding, photographs, videos, product descriptions, packaging or related content
• Stop representing any connection to Ouma Bets Gebak
• Confirm in writing that the unauthorised activity has stopped

Failure to comply may result in further action, including but not limited to cancellation of orders, refusal of future orders, reporting of misleading or unlawful conduct, and legal action for unauthorised use of intellectual property, trade mark infringement, brand misuse, passing off, reputational harm and any other remedy available in law.

  1. Promotions, Discounts and Free Shipping

Promotions, discount codes, special offers and free shipping offers are subject to the specific conditions communicated at the time of the promotion.

Ouma Bets Gebak reserves the right to:

• End any promotion at any time
• Correct promotional errors
• Refuse misuse of promotions
• Limit promotional quantities
• Cancel orders where promotions are abused or incorrectly applied

Unless expressly stated otherwise, promotions may not be combined.

A customer may not be entitled to both a discount and free shipping unless the promotion specifically allows this.

  1. Shipping and Delivery

Orders are delivered door to door using third-party courier services, primarily The Courier Guy or any other courier selected by Ouma Bets Gebak.

Once an order has been handed over to the courier:

• Ouma Bets Gebak no longer controls the parcel
• Courier handling falls outside of our control
• Delivery timelines are estimates only
• Delays may occur
• Delivery may take place earlier or later than expected

Ouma Bets Gebak cannot be held responsible for:

• Courier delays
• Courier damage
• Route changes
• Missed delivery attempts
• Incorrect courier scans
• Operational disruptions
• Weather conditions
• Public holidays
• Service interruptions by courier companies
• Labour action, strikes or courier network delays
• Delays caused by incorrect customer information
• Delays caused by the customer not being available to receive the parcel

Although we package products carefully, baked goods are delicate and perishable. Ouma Bets Gebak cannot guarantee that products will arrive in perfect visual condition after courier transport.

  1. Delivery Addresses and Customer Information

Customers are responsible for providing accurate and complete delivery information at checkout.

This includes:

• Full name
• Correct delivery address
• Correct suburb
• Correct province
• Correct postal code
• Correct phone number
• Correct email address
• Any relevant access instructions

Ouma Bets Gebak is not responsible for:

• Incorrect delivery addresses
• Incomplete delivery details
• Incorrect contact numbers
• Incorrect email addresses
• Delays caused by missing information
• Failed deliveries where the customer is unavailable
• Parcels delivered to an address provided by the customer

If a parcel needs to be redirected, resent, recollected or redelivered due to incorrect or incomplete information provided by the customer, all additional courier charges will be for the customer’s account.

  1. Courier Risk

Once an order leaves our bakery and is handed to a third-party courier, the handling, transport conditions, storage environment and delivery process fall outside of our control.

The customer acknowledges that courier transport of baked goods carries risk, including but not limited to:

• Movement during transport
• Heat exposure
• Rough handling
• Delays
• Damaged outer packaging
• Damaged inner packaging
• Visual damage to products

Courier-related damage does not automatically qualify for a refund, replacement or store credit.

  1. Local Collection

Customers selecting the local collection option must choose a collection date during checkout or as otherwise arranged with Ouma Bets Gebak.

Orders are baked fresh specifically for the selected collection date.

By placing a collection order, the customer agrees that:

• Orders must be collected on the selected date
• Collection must take place during the communicated collection hours
• The customer is responsible for remembering the collection date
• Ouma Bets Gebak is not responsible for product quality issues caused by late collection

If an order is not collected on the selected date, Ouma Bets Gebak cannot guarantee freshness, product quality, texture or shelf life beyond that date.

Due to the perishable nature of our products, orders not collected within 48 hours of the selected collection date may be discarded at our discretion.

If this occurs:

• The order will be considered forfeited
• No refund will be issued
• No replacement will be issued
• No store credit will be issued

Customers who anticipate delays must contact Ouma Bets Gebak before the collection date to request an alternative arrangement. Approval remains at the sole discretion of Ouma Bets Gebak.

Once products leave our premises, they cannot be returned for food safety reasons.

  1. Product Shelf Life and Storage

Our baked goods are freshly prepared and may contain perishable ingredients.

Customers are responsible for ensuring proper storage after receiving or collecting their order.

Most products have a shelf life of approximately 2 to 3 weeks, depending on ingredients.

Products containing cream cheese, dairy-based fillings or similar ingredients may have a shorter shelf life.

Product shelf life depends on correct storage.

Unless otherwise stated, products should be stored:

• In a cool, dry place
• Away from direct sunlight
• Away from heat
• Sealed or wrapped after opening
• According to any product-specific storage instruction provided

Ouma Bets Gebak is not responsible for product quality issues resulting from:

• Incorrect storage
• Heat exposure after delivery or collection
• Delayed collection
• Missed delivery
• Extended storage beyond recommended timeframes
• Products being opened and stored incorrectly
• Products being consumed after the Best Before Date

  1. Allergens

Ouma Bets Gebak products may contain or come into contact with common allergens, including but not limited to:

• Gluten
• Wheat
• Eggs
• Milk
• Dairy
• Soy
• Peanuts
• Tree nuts
• Chocolate
• Food colourants
• Preservatives or ingredients contained in third-party products

Although care is taken during preparation, our kitchen handles multiple ingredients and cross-contact may occur.

Customers with allergies, intolerances or dietary restrictions are responsible for contacting us before ordering.

Ouma Bets Gebak cannot guarantee that any product is completely free from allergens unless expressly stated in writing.

  1. Refund Policy

Due to the perishable and handmade nature of our products, all sales are final.

Ouma Bets Gebak does not offer refunds, replacements, exchanges or store credits for:

• Change of mind
• Incorrect orders placed by the customer
• Failure to read product descriptions
• Failure to read policies
• Personal taste preferences
• Texture preferences
• Flavour preferences
• Courier delays
• Courier damage
• Missed deliveries
• Incorrect delivery information
• Late collection
• Products not collected
• Products stored incorrectly
• Products consumed after the Best Before Date
• Slight handmade variations in appearance, size, shape or decoration
• Promotional items, free gifts or samples

Nothing in these Terms & Conditions limits or excludes any rights a consumer may have under the Consumer Protection Act 68 of 2008 or any other applicable South African law.

Where a product is proven to be defective in a way that qualifies for a remedy under applicable law, Ouma Bets Gebak will deal with the matter in accordance with the law.

  1. Incorrect, Missing or Problem Orders

If you believe there is an issue with your order, you must contact Ouma Bets Gebak within 24 hours of delivery or collection.

To investigate the issue, the following information must be provided:

• Clear photos of the product
• Photos of the internal packaging
• Photos of the external packaging
• Photos of the packing slip
• Photos of the courier waybill sticker
• Order number
• Order date
• Delivery or collection date
• Best Before Date visible on the packaging
• A clear description of the issue

Incomplete submissions cannot be reviewed properly and may be declined.

Ouma Bets Gebak may investigate the matter internally. Submission of a complaint or claim does not guarantee a refund, replacement or store credit.

  1. Products Damaged During Transit

While we package our products with care, Ouma Bets Gebak cannot be held responsible for damage that occurs during courier transport.

Courier handling is outside of our control.

Damage claims must be reported within 24 hours of delivery and must include all information listed in Section 14.

Information provided regarding damage may be used internally or for courier reporting purposes, but this does not guarantee compensation.

  1. Order Cancellations

Orders cannot be cancelled once they have been placed.

Cancellation requests may only be considered if:

• The request is made immediately after placing the order
• Payment has cleared
• The order has not yet been prepared, packed, scheduled, dispatched or allocated to production

Approval of a cancellation request remains at the sole discretion of Ouma Bets Gebak and does not guarantee a refund.

Ouma Bets Gebak may cancel and refund an order at its discretion where operationally necessary or where the order breaches these Terms & Conditions.

  1. Refusal of Service and Customer Conduct

Ouma Bets Gebak reserves the right to refuse service, cancel orders, block customers or restrict future purchases where reasonably necessary.

This may apply where a customer:

• Acts abusively toward staff
• Makes threats
• Harasses staff or the business
• Misuses discounts or promotions
• Places suspicious orders
• Attempts unauthorised resale
• Misuses the Ouma Bets Gebak brand
• Causes operational disruption
• Repeatedly submits unreasonable claims
• Provides false or misleading information
• Breaches these Terms & Conditions

Ouma Bets Gebak may refuse future orders from any customer, email address, phone number, delivery address, business or related party where necessary to protect the business, staff, customers, brand, reputation or operations.

  1. Privacy and Personal Information

Customer information collected through our website may include:

• Name and surname
• Contact details
• Delivery addresses
• Billing information
• Payment-related information
• Order history
• Marketing preferences
• Communication records

This information is collected and processed for purposes including:

• Processing orders
• Delivering orders
• Communicating with customers
• Managing customer service queries
• Fraud prevention
• Marketing where consent has been provided
• Legal, accounting and operational recordkeeping
• Protecting the rights and interests of Ouma Bets Gebak

Customer information is stored and processed in accordance with our Privacy Policy and applicable South African privacy laws.

By placing an order, you consent to the collection and use of your information for the purposes reasonably necessary to process, fulfil and manage your order and related business operations.

  1. Intellectual Property

All content belonging to Ouma Bets Gebak is protected and may not be copied, reproduced, distributed, displayed, adapted, edited, used or exploited without prior written permission.

This includes, but is not limited to:

• Business name
• Trading name
• Logo
• Branding
• Product names
• Product descriptions
• Product images
• Videos
• Website content
• Social media content
• Graphics
• Packaging
• Labels
• Marketing material
• Recipes
• Written content
• Product concepts
• Overall brand identity

No person or business may use Ouma Bets Gebak intellectual property in a manner that may confuse customers, imply approval, imply supply, imply partnership, imply endorsement or create the impression of an official relationship where none exists.

Ouma Bets Gebak reserves all rights in its intellectual property and may take action against unauthorised use, copying, misleading representation, trade mark infringement, passing off, reputational harm or any other unlawful use.

  1. Third-Party Links and Services

Our website, courier process, payment process or communication channels may involve third-party service providers.

These may include:

• Payment processors
• Courier companies
• Website platforms
• Email platforms
• Marketing platforms
• Social media platforms

Ouma Bets Gebak is not responsible for the independent actions, failures, delays, policies or systems of third-party service providers.

  1. Limitation of Liability

To the fullest extent permitted by law, Ouma Bets Gebak shall not be liable for any indirect, special or consequential damages, including but not limited to:

• Loss of profits
• Business interruption
• Data loss
• Courier-related delays
• Courier delivery failures
• Missed events
• Missed gifting dates
• Emotional distress
• Loss caused by incorrect customer information
• Loss caused by third-party service providers

Ouma Bets Gebak’s liability, where liability is proven and cannot legally be excluded, shall be limited to the value of the product purchased, unless otherwise required by law.

  1. Consumer Protection Act

Nothing in these Terms & Conditions limits or excludes any rights a consumer may have under the Consumer Protection Act 68 of 2008 or any other applicable South African law.

Where any part of these Terms & Conditions conflicts with a non-excludable consumer right, the applicable law will prevail.

  1. Food Safety Compliance

Ouma Bets Gebak operates in compliance with applicable South African food safety requirements.

Our bakery holds a valid Certificate of Acceptability issued by the relevant local authority, confirming that our premises meet the required hygiene and operational standards.

All products are prepared in a controlled food-safe environment using approved food handling practices.

Once products leave our premises and are handed to a third-party courier or collected by the customer, the handling, storage, temperature exposure and transport conditions fall outside of our control.

By placing an order, the customer acknowledges the risks associated with the courier transport, collection and storage of perishable baked goods.

  1. Changes to These Terms

Ouma Bets Gebak reserves the right to update, amend or replace these Terms & Conditions at any time without prior notice.

The version published on the website at the time of placing an order will apply to that order.

Customers are encouraged to review these Terms & Conditions before placing an order.

  1. Severability

If any part of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining sections will continue to apply.

The invalid or unenforceable section will be interpreted as closely as possible to the original intention, to the extent permitted by law.

  1. No Waiver

If Ouma Bets Gebak does not immediately enforce any right under these Terms & Conditions, this does not mean that we have waived that right.

Any delay, failure or decision not to act immediately does not prevent Ouma Bets Gebak from enforcing its rights at a later stage.

  1. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be handled in accordance with South African law.
