Terms & Conditions – Ouma Bets Gebak

Welcome to Ouma Bets Gebak. These Terms & Conditions (“Terms”) govern your use of our website and the purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms, as well as our Shipping Policy, Refund Policy, and Privacy Policy.

If you do not agree with these Terms, please do not place an order.


1. About Ouma Bets Gebak

Ouma Bets Gebak is an online bakery operating in South Africa, preparing and delivering freshly baked goods via third-party courier services.

By placing an order, you confirm that you are at least 18 years old or have permission from a parent or legal guardian.

All prices are displayed in South African Rand (ZAR). VAT is included in the prices of the products and shipping where applicable.


2. Orders & Acceptance

Once an order is placed, it is considered final.

We reserve the right to:

  • Accept or decline any order at our discretion
  • Limit quantities
  • Cancel orders due to stock availability, operational constraints, or suspected fraudulent activity

Order confirmation emails confirm receipt of your order only and do not constitute a delivery guarantee.


3. Shipping & Delivery

Courier Method

All orders are shipped door-to-door via a third-party courier service (mostly The Courier Guy)

Shipping Schedule

Orders are dispatched on specified shipping days only, as communicated on our website. Delivery timelines provided by couriers are estimates only.

Once an order has been handed over to the courier:

  • Ouma Bets Gebak has no control over delivery delays
  • Courier delays, routing issues, or operational disruptions are not our responsibility

Incorrect Address

Customers are responsible for ensuring that delivery details are accurate and complete at checkout.

We are not responsible for:

  • Incorrect or incomplete addresses or contact information
  • Address changes requested after dispatch
  • Failed or delayed deliveries due to incorrect details

Any additional courier costs resulting from address errors will be for the customer’s account.


4. Refund Policy – No Refunds

Due to the perishable nature of our products, all sales are final.

We do not offer refunds or exchanges under any circumstances, including but not limited to:

  • Change of mind
  • Incorrect orders placed by the customer
  • Failure to read or understand our policies
  • Missed or delayed deliveries
  • Incorrect delivery details
  • Courier delays or damages
  • Personal taste or preference

5. Defective or Incorrect Orders

If you believe there is an issue with your order (such as a missing or incorrect item), you must contact us within 24 hours of delivery.

To submit a query, you must provide all of the following:

  • Clear photographs of the product
  • Photos of internal and external packaging
  • Photos of the packing slip
  • Photos of the courier waybill sticker
  • Order number, order date, and Best Before Date

All information must be sent to info@oumabetsgebak.co.za

Investigations may be conducted, but this does not guarantee a refund, replacement, or credit.

Incomplete submissions will not be reviewed.


6. Damaged Products in Transit

We take great care when packaging all orders. However, once an order leaves our premises, we are not responsible for damage caused during transit.

We do not offer refunds, replacements, or exchanges for courier-damaged products.

Any information provided regarding damage is for internal review or courier reporting purposes only.


7. Order Cancellations

Orders cannot be cancelled once placed.

Cancellation requests will only be considered at our sole discretion, provided that:

  • The request is made immediately after placing the order and funds from order cleared in the business bank account.
  • The order has not yet been prepared, packed, or scheduled for dispatch

Approval of a cancellation does not guarantee a refund, credit, or replacement.


8. Storage & Product Care

Once delivered, customers are responsible for:

  • Correct storage of products
  • Following any care or storage instructions provided

Ouma Bets Gebak is not responsible for product quality issues resulting from incorrect storage after delivery.


9. Privacy Policy

Your personal information is collected, stored, and used in accordance with our Privacy Policy.

This includes information such as:

  • Contact and delivery details
  • Payment information
  • Order history
  • Marketing preferences

By using our website and placing an order, you consent to this collection and use within Ouma Bets Gebak.


10. Limitation of Liability

To the fullest extent permitted by law, Ouma Bets Gebak shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

  • Loss of profits
  • Loss of data
  • Business interruption
  • Courier-related delays or failures

All content on this website, including text, images, logos, branding, and product descriptions, is the property of Ouma Bets Gebak and may not be reproduced, distributed, or used without written permission.


12. Changes to These Terms

Ouma Bets Gebak reserves the right to amend, update, or change these Terms & Conditions at any time without prior notice.

The version displayed on our website at the time an order is placed will apply to that order.


13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be handled in accordance with South African law.

Consumer Protection Act Compliance & Food Safety Certification

Nothing in these Terms & Conditions is intended to limit, waive, or exclude any rights a consumer may have under the Consumer Protection Act, 68 of 2008 (South Africa). Where applicable, statutory consumer rights will apply.

Ouma Bets Gebak operates in compliance with all relevant South African food safety and health regulations and is certified and authorised to prepare and sell food to the public. Our bakery holds a valid Certificate of Acceptability (COA) issued by the relevant local authority, confirming that our premises meet the required hygiene, safety, and operational standards.

All products are prepared in a controlled, compliant environment using approved food-handling procedures. Once products leave our premises and are handed over to a third-party courier, responsibility for handling, storage, and delivery conditions falls outside of our control.

By placing an order, the customer acknowledges and accepts the inherent risks associated with the courier delivery of perishable baked goods.
